The evolution of the family rights follows the path of the family itself. The attempt to maintain the structure of the society through the sacralization of the marital bond, ended up inhibiting the affection issue in an indissoluble marriage. The hierarchyzed model, conservative and patriarcal was a disaster, and suffered a tremendous blow when the extramarital unions began to perform a significant social role, thus causing the rupture of some paradigms. Now emerges a new concept of family, that has as an identifying element the presence of the affection bond. The widening of the family concept beyond the marriage, ended up allowing the recognition of other family entities. So, the unions of people of the same sex, referred to as homoaffective, are, step by step, looking for its insertion as a family at a legal right level\
